Can I sue the company for false safety claims?

Additional Details:
I purchased a small room heater approx 10 mths ago. The other day while in use, the wiring melted
thru it''s housing and to the carpet. We had a difficult time to remove it from the carpet and the
swivel housing compartment broke showing where the wires had melted thru. There is a piece still
stuck to our carpet. We believe that if we hadn''t discovered it when we did would have easily
resulted in a house fire.

Yes, you can sue them for a breach of warranty claim and recover damages for the loss of the heater, carpet replacment and any other items damaged by the melting.
